APPENDIX NO. 1b TO THE TERMS AND CONDITIONS - TRANSACTION FEES

1. The Service Provider charges the Seller a one-off transaction fee for each Transaction executed on the Platform.

2. A Transaction carried out on the Platform shall be deemed to be a Transaction in respect of which the Payment has been made by means of payment services provided by the Provider or in respect of which the Buyer has exercised the deferred payment option of merXu Pay (following the introduction of such service in the Terms and Conditions of merXu). The making of a Payment by means of payment services provided by the Provider or the use of the deferred payment option of merXu Pay shall constitute evidence of the conclusion and performance of the sales agreement to which the Transaction relates.

3. The transaction fee is charged separately from the subscription fees referred to in Appendix No 1a.

4. In the case of a Transaction where the Payment is made using the payment services provided by the Provider, the transaction fee shall be 3.5% of the [Payment Amount] made within the performed Transaction.

5. In the case of a Transaction where the Buyer has used the merXu Pay deferred payment option, the transaction fee shall be 3.5% of the MerXu Pay amount.

6. The transaction fee is non-refundable, including in the event that the Buyer or the Seller withdraws from the Transaction and in the event of a complaint made concerning the Product or Service. The transaction fee is not refundable in the event of suspension or deletion of an Account on the Platform. The rights of entrepreneurs under mandatory legal provisions are not affected by this provision.

7. MerXu reserves the right, at its own discretion and as part of current promotional campaigns, to grant individual discounts and rebates on the value of the transaction fees charged.

8. In the case where individual rebates granted for transaction fees have an expiry date, any change to the amount of the rebate will be communicated at least 21 days prior to its expiry.

9. It is unacceptable for the Seller to pass on the transaction fee onto the Buyer.
